Abstract:
The franchise has become one of the most widespread business models selected by a huge number of enterprises across the world. Suffice (it) to say, enterprises irrespective of franchisor or franchisee have gained a wealth of benefits through franchise. However, enterprises also face numerous risks from this kind of activity, and the risk pertaining to get-up or trade dress has attracted more concerns of enterprises. Consequently, enterprises attempt to seek protection from the competent authorities for their get-up. To the extent of this paper, general matters of get-up, the protection for get-up in accordance with the laws of New Zealand and Vietnam, and some notes in protecting get-up in franchises and recommendations will be analysed.
