Abstract:
In this thesis an examination will be made of some aspects of the law of damages in personal injury claims. In this chapter, consideration will be given to the general principles to be applied when assessing damages. In the following chapters, a more detailed examination will be made of the application of these principles to the assessment of damages when dealing with particular heads or types of damages in personal injury cases. An explanatory account then follows of certain statutory provisions which are peculiar to New Zealand and which relate to the assessment of damages in fatal accident cases, and this is followed by a discussion of the value of actuarial evidence and calculations when assessing damages. Since this thesis was commenced, a new publication on the law of damages has been published by H. A. Street. (1962) Principles of the Law of Damages (Stevens) Wherever relevant, a discussion of Street's views has been incorporated in the text.
