Abstract
This paper will examine the different approaches of New Zealand and the United Kingdom in the application of the IPA analysis. As Lord Carswell states in Januzi: “Accommodation of these principles has been attempted by two avenues, the choice of which may be critical, for it may lead to different results in individual cases”. The effect of these differences means that it is harder for a claimant to successfully achieve refugee status in the United Kingdom than in New Zealand. As the two approaches can lead to quite different outcomes, it is important to determine how exactly the approaches differ and why they are different.
